案件简要说明

局外人果冻肚皮糖果公司(以下简称果冻肚皮糖果公司)是一家世界知名的糖果生产商和销售商。原告是吉利贝公司在中国投资设立的公司。根据双方商标许可合同，原告是“果冻肚”和“吉利贝”注册商标(以下简称涉案权利商标)在中国的合法使用者，有权以自己的名义提起商标侵权维权诉讼。

经调查，原告发现两被告擅自进口并销售吉利贝公司在美国销售的糖果产品，并在产品上附上“吉利贝”商标。被告进口和销售的产品是按照美国食品标准生产的，产品中含有食品添加剂双乙酸钠，不符合中国的行业规定。2.被告擅自进口、销售上述商品，可能影响涉案商标的市场声誉，损害商标的质量保证功能。因此，原告提起诉讼，要求承担停止侵权和赔偿经济损失的侵权责任。
